TERMS AND CONDITIONS
We welcome Users to the website, “Medicalark.in” (“the Site”) of Radwan Technologies Private Limited (“the Company”). We also welcome Users to the Software application (‘the App”) owned by the Company.
You may purchase cosmetics, surgical products, ayurvedic products and medicines, medical instruments and apparatus (“the Products”) as per your requirements through the Site/App from the comfort of your residence.
The Company owns the Site/App, and declares that the access of the same is strictly subject to compliance with these Terms along with Privacy Policy and Disclaimer Statement (collectively referred to as “Terms of Use”).
All Users are requested to read these Terms of Use, and comply with the same. Users agree and acknowledge that your use of the Site/App will be deemed to be your agreement and compliance with these Terms of Use, and you shall refrain from accessing the Site/App in the event of disagreement.
Users agree and acknowledge that these Terms of Use constitute an electronic contract binding on you although signatures are not affixed physically. This also implies that only individuals above the age of 18 are eligible to access the Site/App.
Applicable Laws:
These Terms of Use form an electronic record in terms of the Information Technology Act, 2000 and rules there under as applicable, and amendments to these till date.
Definitions:
“Users” means and refers to individuals who access and use the Site/App.
“We/Us/Our” means and refers to us at the Company.
“You/Your” means and refers to Users who access and use the Site/App.
Registration:
Users are required to obtain a registration on the Site/App by providing us information as stated in the Privacy Policy. A User account is created through such registration, which will be protected with passwords. Users are solely responsible for preserving the privacy of your accounts. In the event a User is unable to protect the confidentiality of the secret password of her/his account, it will lead to unauthorized use of the same by a third party, which is not encouraged by the Company.
Purpose of use of the Site/App:
The Site/App may be accessed by Users only for personal purposes. The Company does not encourage access of the same for business purposes. In the event of any such business requirement for use of the Site/App, the concerned User may notify the Company. The Company shall consider the genuineness of the requirement, and an intimation will be sent to the User.
Platform for purchase:
The intent of the Site/App is to make a provision for purchase of Products in accordance with the requirements of Users from any preferred location. The prices of the Products are listed on the Site/App, and these are subject to revisions in accordance with the prevalent market rates. The User(s) may place an order on the Site/App, and remit payments online.
Users agree and acknowledge that you are required to purchase Products worth a minimum amount of Rs. 1000/- (Rupees One Thousand Only) on the Site/App to effect purchase and delivery of the Products.
Users also agree and acknowledge that Products shall be deemed to be purchased in accordance with the minimum number stated on the Site/App.
Delivery of Products:
On confirmation of receipt of payment, the Products are delivered to Users through the logistic partners by Vendors as stated in the Shipping Policy here below. The Company shall not be responsible for the delivery of Products to Users.
Replace, Refund and Return Policy:
In the event a User finds that a Product that has been delivered is perished or expired, or cannot be used for the intended purpose, the Site/App will offer the remedy by way of Refund or Replacement as per the discretion of the User.
The circumstances for replacement or refund are as follows: Products that are perished Products that have crossed expiry date Cannot be used for the intended purpose Products that are totally different from the sample or description
Basic Conditions for Return:
The Product should be unused and unopened. The Product has to be returned within 7 days from the date of delivery.
Refunds
The process of refund would reach the customer within maximum 7 working days from the date of return receipt of the Product given by us. Refunds will not be processed for Products received in a damaged condition.
Shipping Policy:
Shipment processing period
All Orders are processed within 2-3 business days. Orders are not shipped or delivered on weekends or holidays.
In the event of a high volume of orders, shipments may be delayed by a few days. Users shall be given a prior intimation of such delay. Shipment confirmation & Order tracking
A Shipment Confirmation Email is sent to Users once Orders are shipped containing the tracking number(s).
Customs, Duties and Taxes
The Company is not responsible for any customs and taxes applied to Orders. All fees imposed during or after shipping is the responsibility of Users (tariffs, taxes). Damages
The Company is not liable for any Products damaged or lost during shipping.
Correspondences:
Communications between the Company and the Users will be through emails/calls/messages. Users shall ensure that actively used email ids and contact numbers are provided to the Company. The Company is entitled to send emails and messages to Users in relation to the business, and for promotion/marketing of the same. Users accord your consent to receive these during business hours.
Feedback and reviews:
Users may post your feedback, reviews and suggestions on the Services available on the Site/App. The Company shall adopt measures to improve the efficacy of the same. However, the Company is not bound to bring all suggestions into force.
Consequential losses: Users agree and acknowledge that the Company is not liable for any loss caused as a result of access of the Site/App.
Lawful use of the Site/App:
Users shall use the Site/App only for authorised and lawful purposes. Any kind of illicit use for unlawful purposes is strictly prohibited, and strict legal actions shall be initiated. Users also agree and acknowledge that you shall not post any derogatory remark or any content, which infringes the intellectual property rights of third parties on the Site/App.
Duplication of content:
Users agree and acknowledge that the content on the Site/App is copyrighted, and any reproduction/duplication of the same for any purpose whatsoever without the prior written consent of the Company is strictly prohibited.
Indemnification:
Users agree to indemnify the Company to the highest extent permitted by law against all losses/damages/consequences/accountabilities/costs arising out of: Your use/access of the Site/App; Your breach of the Terms of Use; Your actions in non- compliance with the applicable laws and regulations
Amendments:
Users agree and acknowledge that the Terms of Use may be revised at periodic intervals by the Company. You are solely responsible to keep yourself updated of the same. The Company is not bound to give you any intimation of such amendments.
Effects of Termination:
By termination of this contract, access to this Site/App is ceased and we shall, in addition to any other legal or equitable remedies, immediately revoke all password(s) and account identification issued to you and deny your access to and use of this Site/App in whole or in part. Termination of this agreement shall not affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination. You agree that the Site/App cannot be made liable for suspension or termination of this agreement. If you are dissatisfied with the Site/App or with any terms, conditions, rules, policies, guidelines, or practices of our Services in operating the Site/App, your sole and exclusive remedy is to discontinue use of the Site/App.
Governing Laws and Jurisdiction:
These Terms of Use are governed by the laws of India. Any disputes relating to the same will be subject to the exclusive jurisdiction of the Courts of Tamil Nadu, India.
